Digital Dialer Terms of Use

Acceptance and account authority

By creating an account, accepting these Terms, or using Digital Dialer, you confirm that you are at least 18 years old and authorized to act for the person or business associated with the account. You must keep account credentials secure and are responsible for activity performed through your account.

Your responsibility for using Digital Dialer

You control the calls, messages, campaigns, contact lists, scripts, recordings, AI instructions, and other content sent or created through your account. You are solely responsible for ensuring your use is lawful, accurate, authorized, and appropriate, including obtaining every consent, license, disclosure, and permission required where you and your contacts are located.

Communications and AI compliance

You are responsible for telemarketing, do-not-call, messaging, call-recording, privacy, consumer-protection, intellectual-property, and industry-specific obligations. AI-generated content may be incomplete or incorrect and must be configured, supervised, and reviewed by you. Digital Dialer does not provide legal advice or guarantee that a campaign or communication complies with law.

Additional carrier compliance charges

The initial messaging registration price does not include a later carrier or registry request for an appeal, retry, special vetting, or other additional review. If Twilio or another provider contacts you about a paid registration action, you must report the request through Digital Dialer's Additional compliance charges section before authorizing that action. Digital Dialer will verify the request, disclose the provider fee and a $4 Digital Dialer service fee, and offer a separate secure checkout. You authorize only the specific quoted total when you complete that checkout; accepting these Terms alone does not authorize an automatic charge to a saved card. Your payment is made to Digital Dialer, which pays or is billed by its provider account. A Twilio email, provider approval, or prior registration payment does not establish that the additional fee has been paid to Digital Dialer. Digital Dialer may withhold authorization, campaign submission, sender attachment, and registered messaging access until the additional charge is paid and verified, or Digital Dialer confirms in writing that no additional fee applies. If you independently authorize a provider charge that is billed to Digital Dialer without following this process, you remain responsible for the documented provider charge and disclosed service fee, subject to applicable law. Digital Dialer may place the affected registration on payment review and request reimbursement before restoring messaging access. A free correction or resubmission does not incur the $4 service fee unless a separate paid action is quoted and accepted. Provider review outcomes and timelines are outside Digital Dialer's control; payment does not guarantee approval.

Affiliate program commissions

Approved affiliates may earn commissions only on eligible paid Mass Dialer + Mass Texting and Lead Gen AI base subscriptions purchased by qualifying referred customers. Phone-number rentals, usage charges, registrations, credits, refills, top-ups, additional AI numbers, taxes, and any other excluded products do not earn commission. Attribution lasts 30 days from a valid tracked referral, commissions remain pending for 30 days, and the minimum payout is $50. An affiliate earns 12% during months 1 through 12 of the affiliate's active commission period and may earn 15% beginning in month 13. A qualifying referral occurs when a new customer completes registration through the affiliate's tracked link or code and passes Digital Dialer's eligibility and fraud checks; clicks, self-referrals, duplicate accounts, or other artificial activity do not qualify. If no qualifying referral occurs during any continuous six-month period, the active commission period resets. The next qualifying referral starts a new month 1 at 12%, and the affiliate must then complete another 12 active months before becoming eligible for 15%. No commission is earned on a payment that is refunded, reversed, disputed, charged back, fraudulent, unpaid, or otherwise canceled. Pending commission will be voided, and commission already paid may be deducted from future payouts or applied as a negative affiliate balance. Affiliate payouts are arranged manually through Bank Transfer, Wise, or AirTM after the minimum and hold requirements are satisfied. Affiliates must provide accurate recipient contact, destination-country, and transfer-preference information and respond to secure requests for any additional payment instructions. Provider availability, exchange rates, receiving-bank charges, intermediary fees, and transfer timing vary by country and may affect the final amount received. A payout is complete only after Digital Dialer records the external transfer reference and marks it paid. Affiliates must make clear and conspicuous disclosures that they may receive compensation, may not make false or misleading claims, and must follow applicable advertising, privacy, and consumer-protection laws. Digital Dialer may review, withhold, adjust, or terminate commissions for errors, abuse, fraud, policy violations, or ineligible transactions.

Platform and provider limitations

Digital Dialer depends on telecommunications, payment, hosting, mobile, AI, and other providers. Services may be delayed, filtered, rejected, unavailable, or changed. To the maximum extent permitted by law, Digital Dialer, Mobile App Starter, and their affiliates are not responsible for your conduct, campaign results, legal violations, provider decisions, lost opportunities, or indirect or consequential losses arising from your use of the platform.

Acceptable use

You may not use Digital Dialer for unlawful, deceptive, fraudulent, harassing, abusive, discriminatory, infringing, or unauthorized communications; to evade carrier or platform safeguards; or to contact people without legally sufficient permission. We may restrict or suspend activity to protect recipients, providers, the platform, or the public.

Subscriptions, cancellation, and service changes

Recurring services renew until canceled. You may manage cancellation through the available billing controls or contact support. Cancellation applies to future renewals and does not itself delete your account. Features, allowances, prices, provider requirements, and availability may change, but material changes will be disclosed as required by applicable law.

Indemnity and limits that cannot be waived

To the maximum extent permitted by law, you agree to defend and indemnify Digital Dialer, Mobile App Starter, and their affiliates against claims, penalties, losses, and reasonable costs resulting from your content, contacts, campaigns, instructions, legal violations, or misuse of the service. Nothing in these Terms excludes rights or liability that cannot legally be excluded, including any mandatory consumer rights that apply to you.

Changes and renewed acceptance

We may revise these Terms as the platform or legal requirements change. When we publish a new version, signed-in users must review and accept it before continuing to use protected platform services. We retain the version, date, IP address, and browser information associated with each acceptance for security, compliance, and dispute-resolution purposes.
